High Court Schedules Mid-April Hearing for Gachagua’s Compensation Claim

The High Court has set aside April 14, 15 and 16, 2026 for the full hearing of former Deputy President Rigathi Gachagua’s compensation case arising from his impeachment. The matter will be argued before a three-judge bench after scheduling was adjusted to avoid the Easter recess.

At a court session on Tuesday, Gachagua’s lead lawyer, Senior Counsel Paul Muite, asked the bench to prioritise the matter, saying his client wanted a final and swift determination of the legality of his removal from office.

Under the timeline fixed by the court, Gachagua will present his case on April 14, the State will respond on April 15, and any rejoinder from Gachagua’s team will be heard on April 16. Hearings will start at 10:00 a.m. daily and will be conducted physically in court.

The April dates replace an earlier March schedule that was shifted because of the Easter holiday. During the session, the bench also dealt with a separate application by advocate Harrison Kinyanjui, seeking a larger bench to hear related petitions. That request is due for consideration on February 26, 2026.

Central to the case is Gachagua’s argument that his impeachment was unconstitutional and unlawful, which he says caused him financial and reputational losses. He is seeking compensation for the remainder of the term he believes he was prevented from serving.

The proceedings follow a Supreme Court ruling on January 30, 2026, where the apex court clarified it lacked jurisdiction to halt High Court cases related to the impeachment.
